Texas Health & Safety Code Sec. 437.01235 prohibits the city from levying a fee on a premises within city limits that has obtained a TABC alcoholic beverage permit if the premises is a food service establishment, retail food store, mobile food unit, roadside food vendor, or temporary food service establishment that has already paid a fee to operate to the department or to any county, municipality, or public health district.
Notwithstanding the above, all premises within city limits that have been issued a TABC alcoholic beverage permit are still required to furnish the city a copy of their TABC application & permit along with the city’s application. Premises that do not fall under Texas H&S Code Sec. 437.01235 must also submit the city fee in accordance with the city’s fee schedule. Confirmation of receipt and instructions on payment procedures will be emailed to you within two business days. If you need to submit a hardcopy, see addresses below. A prepaid self-addressed envelope MUST be included with your hardcopy submittal to have the original returned to you, if needed.
